Is it possibly already too late for a lawsuit?

NO - at least in German courts this is not the case. However, it is advisable to file your claim soon as time is running out. There is NO risk: you only have the option of enforcing your claim and reclaiming your money.

Should I expect difficulties with my lorry supplier if I demand a refund from the manufacturer?

NO. Many of those affected are already taking legal action against the cartelists. The manufacturers are keen to maintain their relationships with customers and not lose them to the competition. Their suppliers were also not informed about the cartel and are therefore not affected.

What costs should I expect?

There are no up-front costs for you! The litigation funding organisation covers all the risks associated with the costs.

In the event of a successful outcome, the legal costs are first deducted, which amount to a flat rate of 5% of the compensation amount. This fixed upper limit ensures that you are not surprised by unexpectedly high legal costs.

The remaining amount is then split 65:35 (customer: financing organisation for the procedure).

An example to illustrate this:

For example, if you receive 10,000 euros in compensation for a vehicle, 500 euros will be deducted for legal costs.

The litigation funder receives 3,350 euros (35%) of the remaining 9,500 euros, leaving you with 6,175 euros.

How long can the procedure take?

It is difficult to determine an exact duration. The courts are currently ruling in favour of the plaintiffs. If a settlement is reached soon, claims could be enforced more quickly. However, if the manufacturers maintain their current position, the proceedings could possibly drag on for several years. As a rule, such a process takes between 10 and 18 months.

What happens if the procedure is lost?

In this case, the litigation cost financier bears all costs incurred, including court fees, expert witness fees and lawyers' fees as well as the costs of the opposing lawyers. You do not incur any costs.

Which limitation periods are relevant?

The exact limitation period is disputed among lawyers. Our lawyers are of the opinion that claims can still be made for purchases made after 1 January 1998.

How can I be sure that this is not fraud?

The European Commission has published a official press release which provides you with certainty. Under the section ‘Action for damages’, it is clearly stated that every injured party is entitled to compensation in such cases. A decision by the Commission serves as binding evidence of the cartelists' illegal behaviour and enables the claim for damages. Even if the Commission has imposed a fine on the companies, this does not affect the right to compensation.
